Diminished value:
the invisible loss on a Swiss vehicle

Even after a technically perfect repair, an accident vehicle may sell for less. Under German liability law, this commercial diminished value can be recoverable in addition to repair costs if it is justified and quantified.

1. What is commercial diminished value?

A repaired accident vehicle can achieve a lower market price than an accident-free equivalent, even after a technically flawless repair. Buyers pay less and the repaired accident must be disclosed on resale. This real financial loss is commercial diminished value and can be recoverable in addition to repair costs.

Recognised claim

German liability practice has recognised diminished value for decades. Whether it exists and how much it is depends on the particular vehicle and damage. Insurers usually consider it only when a report explains and quantifies it.

There is no statutory formula. Experts use recognised methods including MFM, Ruhkopf/Sahm and BVSK, considering replacement value, repair costs, damage, age and mileage. The result remains an expert estimate that must be reasoned.

Example

A three-year-old estate car with 60,000 km, replacement value CHF 28,000 and repair costs CHF 9,500 including work to a side panel may, depending on method and market, have diminished value of about CHF 800–1,500. The result may be lower or higher depending on the vehicle and damage.

4. The Swiss market matters

A Swiss-registered vehicle will later be sold on the Swiss used-car market. The diminished value must therefore reflect Swiss market conditions and be stated in CHF, not derived uncritically from German market values.

Common mistake

Insurers seldom volunteer this payment and may reject it with generic references to age or mileage. Have any reduction checked rather than accepting it automatically.

6. How to claim

  1. Commission an independent report before repair.
  2. Require a reasoned diminished-value figure based on the Swiss market in CHF.
  3. Claim it separately from the German liability insurer; it may also accompany notional settlement.
  4. If reduced, obtain the expert's technical response.

No. There are no rigid age or mileage limits; the individual vehicle and market determine the result.

The Swiss market in CHF is relevant because that is where the vehicle would be sold.
